The terms of using Aretia.

Who can use Aretia

Aretia is for adults. You must be 18 or older to use it. By using Aretia you confirm that you are.

Your licence to use Aretia

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Aretia on devices you own or control, for your own personal, non-commercial use, in line with these Terms and any app store rules that apply. You agree not to:

• copy, resell, rent, sub-licence, or commercially exploit Aretia;
• reverse engineer, decompile, or disassemble the app, except where that restriction is prohibited by law;
• remove or alter any notice of ownership; or
• use Aretia in any way that breaks the law or interferes with the service or other users.

Beta software

Aretia is in beta and is currently free of charge. Beta features may change, pause, or be removed, and the software may contain defects. To the extent the law allows, beta access is provided on an "as is" basis. Your statutory rights below still apply.

Purchases

Aretia is built around a one-off purchase model. When paid access is offered:

• Aretia is a one-time purchase, not a subscription. There is no recurring charge.
• Purchases are processed by the Apple App Store or Google Play, not by us directly, and their billing terms apply.
• Pricing is shown before you buy and may change for future purchasers.
• Refunds are handled under the relevant store's refund policy and under the consumer guarantees below, which we do not limit.

Your data and your content

Your logged data is yours. Your training, meals, bodyweight, notes, and profile are stored on your device, and we do not access them in normal use. How information is handled is set out in our Privacy Policy.

Feedback. If you send feedback, you grant us a non-exclusive, royalty-free licence to use it to operate and improve Aretia. You do not have to send feedback, and you can ask us to delete what you have sent.

Our intellectual property

Aretia, including the app, its design, the cited-evidence compilation, the exercise and coaching content, and the Aretia name and marks, is owned by Flow Through Logic or its licensors and protected by intellectual property laws. These Terms give you a licence to use Aretia, not any ownership of it.

Health and fitness

Aretia gives general educational guidance based on published research and formulas. It is not medical advice and is not a substitute for professional care. Your use is also governed by the Health and Medical Disclaimer, which forms part of these Terms. Read it before acting on anything Aretia shows you.

Acceptable use

Use Aretia for your own training and nutrition. Do not use it to harm yourself or others, to break the law, or in a way a reasonable person would consider unsafe given your own health and circumstances.

Your rights under the Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time, and if this is not done, to cancel and obtain a refund for the unused portion. Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

Disclaimers and limit of our liability

Subject to the section above and to any rights you have that cannot be excluded by law:

• Aretia is provided on an "as is" and "as available" basis, and we do not warrant that it will be uninterrupted, error free, or fit for a particular purpose beyond what the law requires.
• We are not liable for loss or damage that is not reasonably foreseeable, nor for your decisions about training, nutrition, or health, which remain your responsibility and that of the professionals you consult.
• Where our liability can be limited but not excluded, our total liability is limited, at our option, to resupplying the service or refunding the amount you paid for Aretia.

App store terms

You get Aretia through the Apple App Store or Google Play, and their terms also apply.

For the Apple App Store, you acknowledge that these Terms are between you and Flow Through Logic only, not Apple; Apple has no obligation to provide support or maintenance for Aretia; Apple is not responsible for any product claims, legal claims, or third-party intellectual property claims relating to Aretia; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

For Google Play, the Google Play Terms of Service apply to your download and use.

Suspension and termination

You may stop using Aretia at any time by uninstalling it. We may suspend or end your access if you breach these Terms or use Aretia unlawfully. Sections that by their nature should survive (ownership, disclaimers, liability, governing law) continue after these Terms end.

Changes to these Terms

We may update these Terms as Aretia develops. We will change the date above and, for significant changes, give clear notice in the app or on the site. Continuing to use Aretia after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the Australian Capital Territory, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that territory. This does not take away any protection you have under the law of the place where you live.
